Collectivator acts as a venue to allow users who comply with Collectivator's policies to offer, sell, and buy certain goods. Collectivator is not directly involved in the transaction between buyers and sellers. Collectivator offers no warranty over the quality, safety, accuracy or legality of any aspect of the items listed, or the ability of sellers to sell items or the ability of buyers to pay for items. In addition, no advice or information (oral or written) obtained by you from Collectivator shall create any warranty. Collectivator does not pre-screen users or the content or information provided by users. Collectivator cannot ensure that a buyer or seller will be able to complete a transaction. You agree that Collectivator is a venue and as such is not responsible or liable for any content, for example, data, text, information, usernames, graphics, images, photographs, items, and links posted by you, other users, or outside parties on Collectivator.
Collectivator does not transfer legal ownership of items from the seller to the buyer. Consequently, Collectivator encourages you to communicate directly with potential transaction partners through the tools and contact details available on the Site. You may also wish to consider using a third party escrow service or services that provide additional user verification.
Collectivator does not control the content provided by users that is made available on Collectivator. You may find some content to be inaccurate or deceptive. There are also risks of dealing with people acting under false pretense. By using Collectivator, you agree to accept such risks and that Collectivator (and Collectivator’s officers, directors, agents, subsidiaries, joint ventures and employees) is not responsible for any and all acts or omissions of users on Collectivator. Please use caution, common sense, and practice safe buying and selling when using Collectivator.
As a User of the Site you agree that you will not:
- impersonate any person or entity, including, but not limited to, a Collectivator employee or other Collectivator member, or falsely state or otherwise misrepresent your affiliation with a person or entity;
- act in any unruly, disruptive, or offensive conduct while using our Site, communicating with Collectivator, or with any Site user;
- utilize, copy, modify, distribute, or harvest content, including photographs, from the Site for use elsewhere without obtaining advance permission;
- engage in any disruptive technology-related practices such as spamming, hacking, improper use of user information, or any technology that may harm the Site or any Site user
Other Resources: Linked sites are for your convenience only and you access them at your own risk. Collectivator is not affiliated with such sites and is not responsible for linked sites content. You agree that Collectivator shall not be responsible or liable, directly or indirectly, for any damage or loss caused by the use of any such content, goods or services available through any linked websites or resources.
Collectivator does not guarantee continuous, uninterrupted access to the Site, and operation of the Site may be interfered with by numerous factors outside Collectivator’s control.
We have the sole authority and discretion to operate and maintain the Site. Accordingly, we reserve the right to remove any gallery item, picture, page, blog, forum posting or other posting from our Site at any time. We reserve the right to refuse service to anyone, to reject any membership applications, and to discontinue existing service at any time due to unprofessional conduct or practices, buyer complaints, and other issues which we consider, to our sole discretion, to be disruptive to the business and reputation of the Site. In the case of removal of items or discontinuance of service, the poster will be notified by Collectivator using the email address they have provided to Collectivator.
By using our services you represent to us that (a) you are of age of majority and can form legally binding contracts under applicable laws; (b) you have legal title to and ownership of the products and the content (including all intellectual property rights) that you feature on the Site; and (c) the information you have provided to us during the registration process and thereafter, including all information relating to your items for sale, whether or not posted on the Site, is to the best of your knowledge complete, truthful and accurate.
You also agree to:
- deal with all Site users in good faith
- post all applicable information regarding your items for sale including (where known), age of item, condition of item, repairs, and verifications. If a manufacturer's mark is present on an item it must be described.
- post items that reflect the standards of the Site. The sale of reproductions, made up items, crafts or common flea market material is strictly prohibited.
- correctly categorize your stock. Collectivator reserves the right to question or remove an item listing in the event that we believe it is a reproduction, categorized incorrectly, or in any other way fails to meet our standards.
- Give us express permission to use images of your items in our online and print advertisements, as well as in site promotions.
Re-Posting Content: By posting Content on Collectivator, it is possible for an outside website or a third party to re-post that Content. You agree to hold Collectivator harmless for any dispute concerning this use.
Password: Keep your password secure. You are fully responsible for all activity, liability and damage resulting from your failure to maintain password confidentiality. You agree to immediately notify Collectivator of any unauthorized use of your password or any breach of security. You also agree that Collectivator cannot and will not be liable for any loss or damage arising from your failure to keep your password secure.
Account Information: You must keep your account information up-to-date and accurate at all times, including a valid email address.
Resolution of Disputes and Release
In the event a dispute arises between you and Collectivator, please contact Collectivator.
Should you have a dispute with one or more users, or an outside party, you release Collectivator (and Collectivator's officers, directors, agents, subsidiaries, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature in any way connected with such disputes. Collectivator encourages users to report user-to-user disputes to your local law enforcement, or a certified mediation or arbitration entity, as applicable.
Collectivator, for the benefit of users, may try to help users resolve disputes. Collectivator does so in Collectivator’s sole discretion, and Collectivator has no obligation to resolve disputes between users or between users and outside parties. To the extent that Collectivator attempts to resolve a dispute, Collectivator will do so in good faith based solely on Collectivator’s policies. Collectivator will not make judgments regarding legal issues or claims.
Revocation of Membership
Users may subscribe to Collectivator by paying a monthly fee to become a member that sells on Collectivator. This membership may be revoked at the sole discretion of Collectivator. If membership is revoked, the current month's subscription fee will be refunded.
We do reserve the right to decline an application for membership.
As a seller or user who gives permission for the site to send you emails, you will join a list of our contacts. Collectivator will send occasional emails to our contact lists with news from the Collectivator community. Collectivator will not sell or disclose email addresses to third parties without your explicit consent. Every one of our emails comes with an "unsubscribe" option for safe and easy contact removal.
You and Collectivator are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
